First-Grade Teacher Kicks Student Out Of Class. When Mom Finds Out The Reason Why, She Sues The Teacher.

A mom in Indiana has filed a lawsuit against her son’s elementary school after the young boy was allegedly forced to recite the Pledge of Allegiance.
According to FOX 59, the lawsuit, which was filed by the ACLU on behalf of the boy’s family, alleged that the boy refused to recite it because he was "protesting" the government.
"He was doing it to protest the government of the United States, as it was racist, greedy and does not care about people," the lawsuit stated.

As documents from the lawsuit state, “the law is clear that the government may not compel anyone, including public school students, to recite the Pledge of Allegiance or to stand when it is delivered.”
Jamie Porter later explained that her son, who was in the first grade, was removed from his class for failing to recite the Pledge of Allegiance.
According to reports, once the boy’s teacher, Kelly McFarland, heard his reason for refusing to participate with the rest of the class, she took him straight to the principal’s office.
The lawsuit states that Principal Mary Beth Harris returned the boy to his classroom, but later pulled him aside to have him “practice” reciting the Pledge of Allegiance.
"She told him that they were going to 'practice' how to do the Pledge of Allegiance and she made him recite the Pledge with her," the lawsuit alleged.
The lawsuit also adds that Porter’s son "was extremely upset at this treatment by his teacher and the principal as he was made to feel that he had done something terribly wrong and was in trouble."
According to FOX News, both Porter and her son are seeking compensatory and punitive damages for the incident.
Porter now claims that the teacher and the principal violated her First Amendment rights by forcing him to recite the pledge after his told them that he did not want to.
Meanwhile, the school district, Vigo County School Corporation, has released its own statement on the matter.
"We are currently reviewing the complaint with our legal counsel and have been advised not to comment on pending litigation," a spokesman for the district said.
After FOX shared this story on Facebook, many commenters accused Porter of telling her son what to say.
“I have a hard time believing a first grader came up with that explanation for not reciting the pledge on his own. When I was in first grade I was more interested in power rangers and hot wheels than politics,” one commenter wrote.
