Dad Going To Park With Kids Arrested For Being Drunk - Cops Fail To Notice One Thing (Video)

Police in West Virginia arrested a man who was walking his children to the park because they thought he appeared intoxicated, but unbeknownst to them, he was reportedly merely showing symptoms of his terminal illness.

According to The Daily Mail, 39-year-old Jeffrey Banes was allegedly approached and brutally arrested while walking his kids to the park because the officers thought he was under the influence of a substance. Banes, however, suffers from Huntington’s Disease, which characteristically makes a person look intoxicated due to lost motor function over time.

The incident, which took place on September 6, was caught on camera, and while officers pinned him down after using pepper spray on him, Banes choked on his own blood and cried for help. Banes was arrested and charged with disorderly conduct, obstructing an officer, and battery on an officer.

“Assuming because of his appearance he was high on narcotics with out reason they began to subdue him, macing and beating him in the head as he fell to his face were he was —  then held with a great amount of force by two officers double his size as a third one landed on his torso,” said Banes’ nephew Josh to The Free Thought Project.

According to a criminal complaint, the officers arrived at the scene because they were told that Banes was roughly handling his children and that he was under the influenceof drugs.

“The children appeared to be overheated, and when asked about provisions that he had with him for the children, Bane struck the stroller violently with his hand, pushing it forward abruptly while his infant son was still seated inside,” police claim in the report. Police also say that Banes spit on and kicked one of the officers trying to arrest him. Banes’ family, however, vehemently denies those claims.

“As my uncle and his two children headed towards the store before heading to the park together they crossed an intersection to the other side when the stroller became hung up on the curb,” said Josh Banes. “As the light changed, to keep his children out of harms way, he hurriedly put his 2-year-old on the curb, told her to stay put and pulled the stroller up on the curb.”

Josh Banes claims that officers spent 10 minutes arresting his uncle and that the young kids were left unattended while their terminally ill father choked on his own blood.
